Critical Legal Release & Assumption of Risk

FreeMarket.page operates solely as a free, decentralized communications directory and venue connecting independent peer-to-peer buyers and sellers. The domain owners, creators, operators, and developers exercise zero control over users, product quality, item authenticity, physical meetings, financial settlements, or offline actions. By using this domain, you unconditionally release the domain owners from any and all liability, claims, or damages.

Nature of the Venue & Communications Directory

FreeMarket.page is an online technology directory and venue designed to allow independent individuals and merchants to create public storefronts ("FreeMarket Pages"), post local item listings, submit non-binding offers, and communicate directly with one another.

FreeMarket.page is NOT an auctioneer, broker, merchant, escrow agent, payment processor, or party to any transaction. We do not take title to, possess, store, inspect, verify, deliver, package, or guarantee any goods or services listed on the domain. Any contract of sale or trade is formed solely between the buyer and the seller.

Comprehensive Release of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT THE OWNERS, OPERATORS, CREATORS, DEVELOPERS, AFFILIATES, AGENTS, AND HOSTING PROVIDERS OF FREEMARKET.PAGE (COLLECTIVELY, THE "DOMAIN OPERATORS") SHALL HAVE NO RESPONSIBILITY OR LIABILITY WHATSOEVER FOR:

User Conduct & Interactions: Any actions, omissions, representations, misrepresentations, fraud, harassment, negligence, or misconduct of any user, buyer, seller, or visitor on or off the platform.
Product Safety & Legality: The quality, safety, genuineness, merchantability, fitness for a particular purpose, condition, or legality of any item or service advertised, traded, or sold through the domain.
In-Person Exchanges & Meetups: Any bodily injury, personal harm, physical damage, theft, assault, or loss occurring during, resulting from, or in connection with in-person meetings, pickup arrangements, deliveries, or inspections.
Financial Settlements & Non-Payment: Any failure of payment, chargebacks, disputed transfers, counterfeit currency, or loss arising from direct payment methods (including Cash, Venmo, Zelle, Cash App, Bitcoin, or other peer-to-peer mechanisms).

YOU AGREE TO DEFEND, INDEMNIFY, AND HOLD HARMLESS THE DOMAIN OPERATORS FROM ANY CLAIMS, DEMANDS, LIABILITIES, DAMAGES, LOSSES, COSTS, AND EXPENSES (INCLUDING REASONABLE ATTORNEYS' FEES) ARISING OUT OF OR IN ANY WAY CONNECTED WITH YOUR USE OF THE DOMAIN, TRANSACTIONS WITH THIRD PARTIES, OR VIOLATION OF THESE TERMS.

Third-Party Events, Security Breaches & Unforeseen Outages

While reasonable safeguards are implemented, the Domain Operators have no control over the global Internet infrastructure, malicious third-party actors, hostile cyber-attacks, data intercepts, or external system failures.

The Domain Operators shall not be held liable for any data breaches, unauthorized access, malware injection, server outages, Cloudflare network disruptions, communication loss, loss of listings, corruption of media, or any other event, security incident, or casualty outside of the Domain Operators' direct and reasonable control.

Prohibited Items & Services (Texas & Federal Law Compliance)

FreeMarket.page strictly prohibits the listing, marketing, offering, auctioning, sale, or trade of any item, product, or service that violates federal laws of the United States or the laws of the State of Texas.

Users are strictly prohibited from listing any of the following items or services:

Firearms & Tactical Weapons

Handguns, rifles, shotguns, automatic weapons, untraceable "ghost guns," lower receivers, 3D firearm blueprints, silencers/suppressors, bump stocks, explosive devices, grenades, and military-grade ordnance.

Illicit Drugs & Controlled Substances

Illegal narcotics, prescription medications, unregulated pharmaceutical substances, synthetic drugs, anabolic steroids, research chemicals, and drug manufacturing paraphernalia.

Stolen & Counterfeit Property

Stolen items, unauthorized replica trademark goods, bootlegs, counterfeit currency/stamps, identity documents, and pirated copyrighted software or digital goods.

Adult Services & Explicit Media

Prostitution, escort services, sexually explicit adult content, non-consensual media, human body parts, bodily fluids, blood products, or organs.

Live Animals & Regulated Wildlife

Live domestic pets (dogs, cats), livestock, exotic wildlife, endangered species, parts derived from protected species (e.g. ivory), in accordance with Texas Parks & Wildlife Department and federal CITES regulations.

Hazardous Materials & Chemicals

Commercial fireworks, volatile explosives, toxic chemical agents, radioactive isotopes, biological hazards, pesticides, and flammable gasses without hazardous shipping authorization.

Alcohol, Tobacco & Nicotine

Alcoholic beverages, liquor, wine, raw tobacco, cigarettes, and e-cigarettes/vaping liquids lacking appropriate Texas Alcoholic Beverage Commission (TABC) and ATF state/federal retail permits.

Official Government Documents

Driver licenses, state identification cards, passports, birth certificates, government employee credentials, law enforcement badges, uniform insignia, and lockpicking devices.

Recalled Products & Unapproved Medical Devices

Consumer goods subject to active US Consumer Product Safety Commission (CPSC) recalls, prescription medical equipment, breast pumps, and unapproved health treatments.

Financial Schemes & Securities

Lottery tickets, raffle entries, pyramid schemes, multi-level marketing solicitations, unregistered securities, credit repair services, and unlicensed money transmission.

Listing any prohibited item will result in immediate listing removal, account termination, and, where mandated by law, notification to relevant state and federal law enforcement authorities.

Platform "Free" and "Fee" Structures — Right to Modify

FreeMarket.page is currently provided as a 0% platform fee service for local peer-to-peer listings and storefronts.

Reservation of Rights: The Domain Operators expressly reserve the unilateral right to amend, update, revise, or change the Terms of Service, platform policies, rules, feature availability, and the platform's "free" or "fee" structures at any time in the future.

Any future introduction of optional premium features, storefront verification tiers, listing promotions, or transaction fees will be published with advance notice on the platform. Your continued use of the domain following the posting of any changes constitutes your binding acceptance of such revised terms.

In-Person Meetups, Safe Zones & Direct Settlement

Users are solely and exclusively responsible for vetting trading counterparties, selecting safe meetup venues, and agreeing on payment terms:

Public Safe Zones Recommended: Users are strongly urged to conduct in-person exchanges during daylight hours in well-lit, high-traffic public locations or designated Police Station Monitored Safe Exchange Zones.
Direct Settlement: Any financial exchange (cash upon inspection, bank transfer, peer-to-peer app) is conducted directly between parties without intermediary custody or escrow by FreeMarket.page.
Zero Warranty of Counterparty: FreeMarket.page does not perform criminal background checks or financial credit screenings on users. You interact with other users entirely at your own risk.

Disclaimer of Warranties ("AS IS" and "AS AVAILABLE")

THE SERVICE, PLATFORM, DIRECTORY, SEARCH FEATURES, AND ALL ASSOCIATED TOOLS ARE PROVIDED STRICTLY ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS, IMPLIED, OR STATUTORY.

THE DOMAIN OPERATORS SPECIFICALLY DISCLAIM ALL IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT, AND MAKE NO WARRANTY THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, ACCURATE, OR ERROR-FREE.

Governing Law, Jurisdiction & Severability

These Terms of Service and any dispute, controversy, or claim arising out of or relating to your use of FreeMarket.page shall be governed by, construed, and enforced in accordance with the laws of the State of Texas, without regard to its conflict of law principles.

You agree that any legal action or proceeding arising under these Terms shall be brought exclusively in the state or federal courts located in Travis County, Texas, and you hereby consent and submit to the personal and subject-matter jurisdiction of such courts.

If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be severed from the remainder of the Terms and shall not affect the validity and enforceability of the remaining provisions.
